CocoBeauty Affiliate Program Terms of Service
Effective Date: April 2024
These Terms of Service ("Agreement") govern participation in the CocoBeauty Affiliate Program ("Program"). The Program is operated by CocoBeauty ("we," "us," "our") and is designed to allow affiliates ("you," "your") to promote CocoBeauty products and earn commissions on resulting sales through tracked referral links.
1. Enrollment in the Program
To participate, you must submit an accurate application and be approved by CocoBeauty. We reserve the right to accept or reject applications at our sole discretion. We may reject applications for reasons including, but not limited to, content that is:
- sexually explicit
- violent or defamatory
- discriminatory
- promoting illegal activity
- infringing intellectual property rights
2. Affiliate Obligations
Once approved, you agree to:
- Use only provided or approved links and promotional materials ("Special Links")
- Not misrepresent your affiliation with CocoBeauty
- Disclose your affiliate relationship as required by law (e.g., "[Your Name] is a participant in the CocoBeauty Affiliate Program")
- Keep your account and contact information accurate and up to date
- Not use coupon, discount, or deal websites unless explicitly approved
3. Strictly Prohibited Activities
The following activities are strictly forbidden and will result in immediate removal from the Program with permanent forfeiture of unpaid commissions:
- Paid Ads on Branded Terms: Bidding on CocoBeauty brand names, product names, or misspellings in paid search or display advertising (including Google Ads, Bing, social ads, etc.) is strictly prohibited.
- Coupon Code Abuse: Generating or promoting general-use coupon codes (e.g., welcome codes, storewide discounts) to claim credit for sales you did not generate is a serious breach of this Agreement.
- False or Misleading Claims: Misrepresenting product benefits, pricing, or affiliate relationships in any form, including on landing pages, social posts, or in advertising.
- Self-Commissioning: Purchasing through your own affiliate links, or encouraging friends, family, or employees to do so.
4. Commission and Payment
Affiliates earn commissions on "Qualifying Purchases," which are:
- Purchases made through properly tracked Special Links
- Made within a 24-hour cookie window or during the same session
- Not returned, cancelled, or refunded
5. Program Termination
Either party may terminate participation in the Program at any time, with or without cause. Upon termination:
- You must stop using CocoBeauty assets and promotional materials
- Unpaid commissions may be withheld for a reasonable period to account for returns or violations
6. Intellectual Property
We grant you a limited, revocable, non-exclusive, non-transferable license to use the CocoBeauty brand assets provided for the sole purpose of Program participation. All intellectual property remains the exclusive property of CocoBeauty.
7. Disclaimers and Limitation of Liability
CocoBeauty makes no guarantees regarding income or performance of the Program. We are not liable for indirect, incidental, or consequential damages arising from participation. Our total liability shall not exceed commissions paid in the prior 12 months.
8. Modifications
We may update these Terms at any time by posting a revised version. Continued participation after changes are posted constitutes acceptance of the new terms.
9. Governing Law
This Agreement shall be governed by the laws of the United States of America. Any disputes will be resolved in the courts of the state of Delaware, unless otherwise required by applicable law.
